Measures for the Administration of examination and approval of the entry and exit of cultural relics

 

Decree 42 of the Ministry of Culture of the People's Republic of China

 

The Measures for the Administration of Examination and Approval of the Entry and Exit of Cultural Relics, which were deliberated and adopted at the Ministerial Meeting of the Ministry of Culture on July 3, 2007, are hereby promulgated and shall come into force as of the date of promulgation。

Measures for the Administration of examination and approval of the entry and exit of cultural relics

 

Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on the Protection of Cultural Relics and the Regulations for the Implementation of the Law of the People's Republic of China on the Protection of Cultural Relics for the purpose of strengthening the administration of the examination and approval of the entry and exit of cultural Relics。

 

Article 2 The State Administration of Cultural Heritage shall be responsible for the administration of the examination and approval of the entry and exit of cultural relics, and designate the examination and approval institutions for the entry and exit of cultural relics to undertake the examination and approval of the entry and exit of cultural relics。

The examination and approval agency for the entry and exit of cultural relics is the administrative law enforcement agency for cultural relics, which independently exercises its functions and powers according to law, reports its work to the State Administration of Cultural Heritage, and accepts the business guidance of the State Administration of Cultural Heritage。

 

Article 3 The examination and approval agency for the entry and exit of cultural relics shall be jointly established by the State Administration of Cultural Heritage and the people's government at the provincial level。The people's government at the provincial level shall guarantee the establishment, office space and working funds of the examination and approval institutions for the entry and exit of cultural relics。The State Administration of Cultural Heritage shall subsidize the operational funds of the examination and approval institutions for the entry and exit of cultural relics。

 

Article 4 The examination and approval institutions for the entry and exit of cultural relics shall meet the following conditions:

(1) There are more than 7 full-time cultural relics appraisers, of which no less than 5 are responsible for the entry and exit of cultural relics;

(2) having a fixed office space and necessary technical equipment;

(3) The working funds shall be fully incorporated into the fiscal budget。

 

Article 5 The State Administration of Cultural Heritage shall, in accordance with the needs of the examination and approval of the entry and exit of cultural relics, appoint qualified examination and approval institutions for the entry and exit of cultural relics, use exit marks and temporary entry marks for cultural relics, and issue exit permits for cultural relics that are allowed to leave the country。

 

Article 6 The staff members of the entry and exit examination institutions for cultural relics shall adopt the post system with certificates, and shall not hold a post or take a part-time job in cultural relics shops or auction enterprises。The principal person in charge of the examination and approval agency for the entry and exit of cultural relics shall obtain the qualification certificate issued by the State Administration of Cultural Heritage。

Cultural relics import and export responsibility appraisers shall obtain a university degree or above and cultural relics professional title of intermediate or above, and pass the examination of the State Administration of Cultural Heritage。

 

Article 7 The daily management of the entry and exit examination institutions of cultural relics shall be the responsibility of the local provincial cultural relics administrative department。Provincial cultural relics authorities shall formulate relevant management systems and report to the State Administration of Cultural Heritage for the record。

The examination and approval institutions for the entry and exit of cultural relics shall take measures to ensure that the examination and approval work is efficient and fair。

 

Article 8 The exit of the following cultural relics shall be subject to examination and verification:

(1) All kinds of art and arts and crafts before 1949 (inclusive);

(2) manuscripts, documentary materials and book materials before 1949;

(3) physical objects related to the social system, social production and social life of various nationalities before 1949 (inclusive);

(4) representative objects related to major events or famous people after 1949;

(5) Objects representing the production activities, living customs, culture, art and religious beliefs of all ethnic groups after 1949;

(6) The works of the late famous modern calligraphers and painters, arts and crafts artists, which are restricted from leaving the country by the State Administration of Cultural Heritage;

(7) Fossils of ancient apes, ancient human fossils, and Quaternary vertebrate fossils related to human activities。

The examination standards for the exit of cultural relics shall be revised and promulgated by the State Administration of Cultural Heritage on a regular basis。

 

Article 9 In transporting, mailing or carrying cultural relics out of China, an exit application form for cultural relics shall be filled out before the cultural relics leave the country and submitted to the entry and exit examination institutions for examination and approval。

The examination and approval institution for the entry and exit of cultural relics shall, within 15 working days from the date of receiving the application for the exit of cultural relics, make an examination and approval opinion on whether to allow the exit。

 

Article 10 The examination and approval institution for the entry and exit of cultural relics shall have more than 3 full-time cultural relics appraisers to participate in the examination and approval, of which no less than 2 are responsible for the entry and exit of cultural relics。

The exit permit for cultural relics shall be jointly signed by the experts responsible for the entry and exit of cultural relics participating in the examination。For cultural relics that are allowed to leave the country, the cultural relics entry and exit examination institution may stamp the special seal for cultural relics exit examination。

 

Article 11 Cultural relics that are allowed to leave the country after examination and verification shall be marked with exit marks by the examination bodies for the entry and exit of cultural relics, and exit permits shall be issued。The Customs shall, after checking the exit marks of cultural relics, release them with exit permits。

The exit permit for cultural relics shall be in three copies. The first copy shall be retained by the entry and exit examination agency for cultural relics, the second copy shall be retained by the customs at the place where the cultural relics leave the country, and the third copy shall be retained by the cultural relics' exit carriers。

Cultural relics that are not allowed to leave the country after examination shall be registered and returned by the entry and exit examination agencies for cultural relics。

According to the requirements of the customs at the place of departure or the carrier, the examination and verification institution for the entry and exit of cultural relics may issue a certificate of the replica of cultural relics for the declared articles that have been examined and are replicas of cultural relics。

 

Article 12 Cultural relics temporarily brought into the country for restoration, exhibition, sale, appraisal and other reasons shall, after being sealed by the Customs, be submitted for examination and registration by the entry and exit examination agencies for cultural relics。After checking that the customs seal is intact, the examination and approval agency for the entry and exit of cultural relics shall examine each temporary entry of cultural relics, mark the temporary entry mark of cultural relics and register it。

When temporarily entering cultural relics are re-entering the country, they shall be declared to the original entry and exit examination agency of cultural relics that examined and registered them。The examination and approval institution for the entry and exit of cultural relics shall check and verify against the entry records, confirm the temporary entry marks of cultural relics without error, mark the exit marks of cultural relics, and issue exit permits for cultural relics。

 

Article 13 The stay time of temporarily entered cultural relics in the territory shall not exceed 6 months, unless approved by the Customs and the entry-exit examination authority for cultural relics。

Temporary cultural relics staying in the territory and returning to the country after the deadline shall be examined in accordance with the examination standards and procedures for the exit of cultural relics。

 

Article 14 Cultural relics temporarily leaving the country for exhibition, scientific research and other reasons shall be declared to the entry and exit examination agency of cultural relics before leaving the country。The examination and approval institutions for the entry and exit of cultural relics shall go through the examination and registration procedures in accordance with the approval documents of the State Administration of Cultural Heritage。

Upon the re-entry of cultural relics temporarily exiting the country, they shall be examined and examined by the entry and exit examination institutions of cultural relics that originally examined and registered them。

 

Article 15 In the process of examining and approving cultural relics, the entry and exit examination institutions of cultural relics find that they are suspected of illegal possession of cultural relics or the loss of cultural relics, they shall immediately report to the public security organs and the State Administration of Cultural Heritage。

 

Article 16 The exit marks for cultural relics, temporary entry marks for cultural relics and exit permits for cultural relics shall be kept by special persons designated by the entry and exit examination agencies for cultural relics。The use of the above articles shall be confirmed by the signature of the person in charge of the entry and exit examination agency of cultural relics。

 

Article 17 Those who violate the provisions of these Measures and cause the loss of cultural relics shall be investigated for responsibility according to the relevant provisions。

 

Article 18 Exit marks for cultural relics, temporary entry marks for cultural relics, exit permits for cultural relics, certificates of replicas of cultural relics and exit application forms for cultural relics shall be uniformly made by the State Administration of Cultural Heritage。

 

Article 19 Provinces, autonomous regions and municipalities directly under the Central Government that have not yet established an entry and exit examination institution for cultural relics shall establish an entry and exit examination institution in accordance with the provisions of these Measures;Before the establishment, the examination and approval of the entry and exit of cultural relics shall be undertaken by the State Administration of Cultural Heritage designated by the examination and approval institutions for the entry and exit of cultural relics。

 

Article 20 These Measures shall come into force on the date of promulgation, and the Measures for the Administration of Exit Appraisal of Cultural Relics issued by the Ministry of Culture in 1989 shall be repealed on the same day。

 

 

Cultural relics exit examination standards

 

(Adopted at the 4th Executive Meeting of the State Administration of Cultural Heritage on April 3, 2007 and effective as of June 5, 2007)

1. This standard is formulated in accordance with the Law of the People's Republic of China on the Protection of Cultural Relics and the Implementation Regulations of the Law of the People's Republic of China on the Protection of cultural Relics in order to strengthen the protection of our cultural heritage and prevent the loss of precious cultural relics。

 

2. The import and export examination institutions of cultural relics shall implement these standards when carrying out the exit examination of cultural relics。

 

This standard takes 1949 as the main standard line。Cultural relics of certain historical, artistic and scientific value produced or produced before 1949 are, in principle, prohibited from leaving the country。Cultural relics produced or produced before or including 1911 are prohibited from leaving the country。

 

4. The year 1966 is the main standard for cultural relics of ethnic minorities。Cultural relics representative of ethnic minorities produced or made before 1966 (including 1966) are prohibited from leaving the country。

 

5. These Standards shall be applied to the classification of foreign cultural relics and books existing in our country, just like those in our country。

 

6. Cultural relics that are detrimental to the interests of the State or the nation, or that are likely to cause adverse social effects, are prohibited from leaving the country, regardless of their age。

 

7. Cultural relics not included in the scope of this standard shall be prohibited from leaving the country if they have great historical, artistic and scientific value after being examined by the entry and exit examination institutions of cultural relics。

 

8. Cultural relics listed in this standard belong to different audit categories and shall be subject to the lower limit of exit prohibition。

 

9. This standard shall be interpreted and revised periodically by the State Administration of Cultural Heritage。

 

After the implementation of this standard, if other provisions previously issued by the State Administration of Cultural Heritage are inconsistent with this standard, this standard shall prevail。

 

Audit category restrictions

Cultural affairs departments (bureaus), cultural relics bureaus, and cultural management committees of provinces, autonomous regions and municipalities directly under the Central Government:

 

In 1989 and 1990, the Bureau twice issued the identification standards for the restriction of the exit of the works of famous painters and calligrapher after the founding of the People's Republic of China, and protected a large number of precious works of famous painters and calligrapher in recent and modern times。According to the current stock of recent and modern famous calligraphers and painters in China, their artistic and academic value, and their exit from the country, there are still many famous calligraphers and painters whose works should be protected by the state and included in the scope of cultural relics exit appraisal。In this regard, the bureau conducted a full investigation and research, and solicited the opinions of cultural relics and art circles, and made corresponding additions and adjustments to the list of famous calligraphers and painters listed in 1989 cultural relics Word No. 185。The Appraisal Standards for the Restriction of Exit of Works of Famous Deceased Calligrapher and Painter after 1949 and the Appraisal Standards for the Restriction of Exit of Works of Famous Calligrapher and Painter from 1795 to 1949 are hereby issued to you, and please comply with them。

 

The Appraisal Criteria for the Restriction of Exit of the Works of famous painters and Calligrapher who died after the founding of the People's Republic of China (Cultural Relics No. 185, 1989), issued in 1989, shall be abolished as of December 1, 2001。

The cultural relics Bureau (Department of Culture) of each province, autonomous region and municipality directly under the Central Government, and the national cultural relics entry and exit examination and Administration Office:

 

In order to strengthen the protection of Chinese modern famous calligraphers and painters works,In 2001, our Bureau issued the "Appraisal Standards for the Restriction of Exit of Works of Famous Dead Painters and Calligrapher after 1949".,Local authorities for examination and approval of the entry and exit of cultural relics strictly implement the standards,Standardize the approval of works and exit restrictions,It has prevented the loss of precious modern and calligraphic works。

 

Since 2001, some famous painters and calligraphers have passed away。In order to strengthen the protection of the works of these painters and calligrapher, the Bureau has drafted additional exit appraisal standards on the basis of soliciting the opinions of experts in the fields of cultural relics, culture and fine arts。
